Canadian Cancer Society 75th Anniversary, Relay For Life Promotion (THE “Contest”)

The Contest begins on January 1, 2013 at 12:00:01 a.m. Eastern Standard Time and ends on November 29, 2013 at 4:59:59 p.m. Eastern Standard Time (the “Contest Period”) and is sponsored by the Canadian Cancer Society (the “Sponsor”).

To enter the Contest, first register as a participant in a 2013 Relay For Life event, anywhere in Canada and collect pledges online. You shall be automatically entered into the Contest for individual prizes when you have collected $750 or more in online donations during the Contest Period. Your team will be automatically entered into the Contest for the team prize when your team has jointly collected a total of $7,500 online donations during the Contest Period. Please note that donations not raised online will not count towards your eligibility. For a list of Relay For Life events in Canada, visit and enter the postal code or name of the city in which you wish to participate. Draws will be made through random selection. Limit one entry per person or team that achieves the set fundraising milestones of $750 per individual and $7,500 per team in the Contest Period. Individuals and teams will not be entered multiple times regardless of how much is raised above and beyond the set fundraising milestones.


This Contest is open to all registered 2013 Relay For Life participants who are residents of Canada and who have reached the age of majority in their province of residence. Employees, agents, or representatives of the Canadian Cancer Society or its advertising and promotion agencies, (and those with whom they are domiciled), are not eligible to participate. Unpaid volunteers of the Canadian Cancer Society may participate.

Individual Prizes: The prizes awarded for the individual fundraising Contest consist of: 1) Ten (10) trips for two (2) on Via Rail to anywhere Via Rail travels in Canada, maximum value $1700 per trip for two. All travelers must travel on the same itinerary. This prize includes Via Rail tickets only; all other costs including, but not limited to, transportation to and from train within departure and destination cities and all points in between, meals, beverages, accommodations, any other incidental costs, taxes and insurance will be the responsibility of the winners. No refund or compensation will be made in the event of the cancellation or delay of any train. Reservations are subject to availability. Travel plans cannot be changed once booked. Travel is subject to the terms and conditions set forth in these rules, and those set forth by Via Rail as detailed in the passenger ticket contract. Team Prize: The team prize is a maximum of ten (10) economy class airline tickets donated by Air Canada. Tickets must be used for a Relay For Life team, consisting of up to ten (10) people, to travel together on the same itinerary, as a team, from a major Canadian airport, for three (3) days and two (2) nights (Friday – Sunday) to attend a 2014 Relay For Life event of their choice, taking place in any city where Air Canada flies in continental North America. Travel must be completed by December 14, 2014. The trip will include two (2) nights’ accommodation for up to (10) team members at a hotel selected and arranged by the Canadian Cancer Society. The accommodation will be two (2) people sharing per room. Approximate retail value $25,000. Actual value may vary based on airfare fluctuations and distance between departure and destination. Should the winning team consist of fewer than ten (10) participants, one (1) ticket will be provided for each team member. Should the winning team consist of more than ten (10) participants, it will be the team’s responsibility to determine which ten (10) team members will be awarded a ticket. Team members cannot be added after the Contest Period. Trip must be booked at least twenty-one (21) days prior to departure and travel must be roundtrip. All travelers must travel on same itinerary. Sponsor will determine all details including hotel and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight or any Relay For Life event. Travel plans cannot be changed once booked. Reservations are subject to availability. Travel is subject to the terms and conditions set forth in these rules, and those set forth by Air Canada as detailed in the passenger ticket contract. Black-out periods apply from December 15, 2013 – January 7, 2014 and April 16, 2014 – April 22, 2014. Additional black-out periods may be added at Air Canada’s discretion. All expenses, travel, and other costs not expressly stated in the package description above are the sole responsibility of winner including but not limited to ground transportation, taxes, gratuities, airline baggage fees, insurance, meals, beverages, service charges, room service, telephone calls, in room movies, and incidental expenses in the hotel. Airline travel is subject to the carrier’s restrictions.

All prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Sponsor’s option. Sponsor reserves the right to substitute the prize or a prize component with one of equal or greater value. Lost, mutilated, or stolen tickets, vouchers or certificates will not be replaced. By accepting any ticket prize, winner agrees to abide by any terms, conditions and restrictions provided by the ticket. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason subject to, in the case of Quebec, the consent of the Régie des alcools, des courses et des jeux (the “Régie”). Travel companions (in the case of the Via Rail trip) must execute liability/publicity releases prior to issuance of prize documents. Restrictions, conditions and limitations may apply. Winners and travel companions are responsible for ensuring that all travel papers required for travel to the applicable destination are valid, in good order and sufficient for the trip.

On December 13, 2013 noon E.S.T., at 55 St. Clair Avenue West, Toronto, Ontario, winners will be selected from all eligible entrants by random draw. The odds of winning depend on the number of eligible entries received. Selected entrants will be contacted by phone or e-mail within (14) days from the draw date. In the case of the team prize, the registered Team Captain will be notified and be deemed to be the “selected entrant” for the purposes of this paragraph. If the selected entrants cannot be contacted within fourteen (14) days of selection or there is a return of any prior notification as undeliverable, that entrant will be disqualified and an alternate entrant will be selected from among the remaining eligible entries. Before being declared a winner, the selected entrant must first correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by telephone at a prearranged mutually convenient time or by e-mail; and b) sign and return a standard declaration and release form confirming compliance with the Contest rules, acceptance of the prize as awarded and releasing the Sponsor, its advertising and promotion agencies, and their respective officers, directors, agents, representatives, successors and assigns (the “Releasees”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Contest or a Relay For Life event, or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Contest, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy. In the case of the team prize each team member must sign and return the aforementioned declaration and release form prior to the team prize being awarded. If the selected entrant cannot be contacted by e-mail or telephone, or fails to return the Contest documents within the time specified therein, (including, in the case of the team, all the team member declarations and releases), he/she will forfeit the prize and an alternate eligible entrant will be selected. This process will be repeated until the prize is awarded.

By entering the Contest, the selected entrants agree to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, in all forms of media including but not limited to print, broadcast or the Internet, worldwide, in perpetuity, without further payment of consideration.
The Releasees are not responsible for late, lost, misdirected, delayed or illegible entries.
Without limitation, the Releasees will not be liable for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software, or for the failure of any entry to be received by the Sponsor, for any reason including, but not limited to, technical problems or traffic congestion on the telephone network, Internet or at any web site; or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
The Sponsor reserves the right to withdraw, suspend or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, subject, in the case of Quebec, to the consent of the Régie. The Sponsor reserves the right to cancel or suspend this Contest at its sole discretion, subject, in the case of Quebec, to the consent of the Régie. Any attempt to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these rules or any other Contest, or in an unsportsmanlike or disruptive manner.
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the Courts of Ontario, Canada; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event legal fees or disbursements; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal. For Residents of Quebec Only: Any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
